  • Divorce Financial Planning - Proprietor, Charlotte, North Carolina. I have worked with hundreds of divorcing or separating clients. A majority of these clients required: Developing the Affidavit of Financial Standing from “source” documents, developing the Equitable Distribution Affidavit from “source documents”, developing the marital asset spreadsheet from “source” documents, grossed up alimony calculations, guideline or “out of guideline” child support calculations, identifying separate property vs. marital property, valuing and dividing marital property, tax effecting retirement assets and/or income, calculating to sell or not sell the marital residence.
  • Forensic Domestic Relations Service - I provide forensic financial services for domestic relations attorneys. This includes cash flow analysis of income, tax effecting for alimony, income vs. expenditure calculations, examination of and explanation of restricted stock, stock options, deferred compensation plans, QDRO's, SERPS, QSIP's and other means of compensation. Preparation of documents and testimony of ability to pay after deductions, testimony of actual needs based on source documents, fraud or hiding income analysis, lifestyle vs. income analysis. I prepare spreadsheets and testify regarding expendable income after application of tax requirements, tax status of liquidation of compensation plans, retirement accounts, expected income returns on stock liquidation and tax consequences. I provide health insurance cost information, determination of blended tax rates, interpretation of employment agreements, "Golden Parachutes", and other benefits.
  • I am familiar with NC General Statutes regarding Equitable Distribution, Alimony, PSS, Child Support, Distributive Factors, Alimony Factors and have provided frequent affidavits and testimony in Family Court. I prepare, on behalf of clients, Financial Affidavits and ED Affidavits."

Experience
  • I have performed expert witness testimony in civil litigation (divorce/equitable distribution matters, actual expenses and reasonable needs of the parties as it relates to Affidavits of Financial Standing, examination of Affidavits of Financial Standing, review of actual data upon which Affidavits of Financial Standings are based, and reasonable needs of a child when the income of the parties exceeds the North Carolina Uniform Child Support Guidelines) and have participated in over 75 mediations.
  • I have prepared numerous Financial "Speaking/text Affidavits", assisted clients in the preparation of their Speaking Affidavits and have been deposed many times.
  • I financially prepare legal counsel for deposition on financial issues and prepare QDROs.
  • I take a fully functioning office to most off site casework. I have been retained as a financial “neutral” or to financially represent one of the parties involved.

I work with over ten financial software applications and have developed a self-totaling Affidavit of Financial Standing, percentage generating marital asset spreadsheet (this spreadsheet provides instant evaluation of equitable distribution proposals), and a monthly budget that allows a client to “sweep” unused dollars to a holding account for non-monthly occurring expenses.

    2. Produce personalized financial DOCUMENTS (FA & ED, WRITTEN REPORTS, CHARTS AND GRAPHS) from “source documents” (Bank & credit card statements, investment statements, liability statements, tax returns) TAILORED TO THE CLIENTS SPECIFIC FINANCIAL SITUATION.
    3. Provide written financial answers to the client's attorney which assists in determining the best and fairest financial outcome for their client.
